On August 21, 2003, the Federal Communications Commission
(FCC) issued its Triennial Review Order (TRO), which adopted new and revised
rules aimed at promoting local telephone and broadband competition in
CC Docket Nos. 01-338, 96-98, and 98-147. In its revised rules, individual
States were required to implement crucial aspects of the TRO related to
the unbundling of the incumbent local exchange carrier's (ILEC) network
pursuant to 47 U.S.C. § 51(c)(3).On June 16,
2004, as a result of USTA II, the D.C. Court of Appeals issued a mandate
to the FCC vacating the rules concerning mass market switching, high-capacity
loops, and dedicated transport.
On July 21, 2004, the FCC adopted an Order and Notice
of Proposed Rulemaking adopting interim unbundling rules and requesting
comment on permanent rules. On December 15, 2004, the FCC adopted new
permanent unbundling rules and the text of that order was released on
February 4, 2005.
