On November 18, 2003, the Michigan Court of Appeals issued its opinion affirming the Commission's
Orders in Case No. U-12639 related to the methodology for calculating and recovery of net stranded
costs, the calculation of securitization credits and the Commission's denial of the Consumers Energy
and Detroit Edison's request for the deskewing of rates.
- PDF - Michigan Supreme Court Decision -- On June 29, 1999 the Supreme Court issued a decision on the MPSC authority to order an experimental "retail wheeling" program.
In a four to three vote the court held that the MPSC lacks statutory authority to order a
utility to transmit a third-party provider's electricity through its system to a customer.
Thus, it lacks the statutory authority to implement the experimental retail wheeling program.
