MPSC Dunks Slammer with $49,400 Penalty
LANSING, September 28. The Michigan Public Service Commission today
levied a fine of $39,400 against CEO Telecommunications, Inc.(formerly known as) LD
Services, Inc., for violations of the Michigan Telecommunications Act and the MPSC's
anti-slamming procedures, and awarded a complainant $10,000 restitution against the
company for these violations. The Commission found that CEO had switched the long
distance service of the complainant without his authorization. The Commission
concluded that these failures fell well beyond the range of "bona fide errors". The
Commission directed CEO to pay the fine, and the restitution to the customer, within 30
days. The Commission also ordered CEO to cease and desist from any further violations
of the MTA and the MPSC's anti-slamming procedures.
Today's order is another step in the process to protect consumers from having
their telephone service switched without authorization. Previously, the Commission has
assessed fines of $660,000 and $940,000 against Brittan Communications International
Corp. and ACI Communications, Inc., respectively, for violations of the MTA and the
Commission's anti-slamming procedures. The Commission has also approved a
settlement providing restitution for a customer who filed a slamming complaint against her
telephone service provider. Additionally, the Commission today approved revisions in the
anti-slamming procedures designed to further protect telephone customers, and
dismissed another telephone slamming complaint because the customer and the
telephone service provider reached a settlement.
"The Commission wants to send a clear message to all telephone service
providers in Michigan that it takes very seriously the duty assigned by the MTA to protect
Michigan consumers from having their telephone service switched without customers'
authorization, and to impose substantial fines whenever slamming occurs," said Chairman
John Strand. "We urge consumers to thoroughly document their slamming complaints
and pursue them through the MPSC complaint process."
The MPSC is an agency within the Department of Consumer and Industry
Services.
