LANSING, June 19. In another series of orders, the Michigan Public
Service Commission took further steps to move electric competition forward in
Michigan. The Commission dismissed several pending cases, determining that
they conflicted with provisions of Public Acts 141 and 142 of 2000. Governor
John Engler signed into law, Public Acts 141 and 142 on June 3, 2000.
The Commission dismissed Consumers Energy Company's application to
reinstate its power supply cost recovery clause as well as The Detroit Edison
Company's requests to implement a power supply cost recovery plan in 2000 and
to reconcile its power supply cost recover revenues and expenses for 1999. The
Commission determined that these requests conflicted with Public Act 141's
provision to institute a rate reduction of 5% for Consumers Energy's and Detroit
Edison's residential customers, effective May 1, 2000 which remains in effect
until December 31, 2003 or later. Commercial and industrial customers will see
a rate freeze under the law. The 5% rate reduction was ordered by the
Commission on June 5, 2000.
The Commission also dismissed complaints about Consumers Energy's
and Detroit Edison's electric rates, filed by the Association of Businesses
Advocating Tariff Equity. Again, the Commission found that any rate adjustment
as a result of these complaints would be inconsistent with Public Act 141.
Finally, the Commission directed nine applicants requesting certificates of
public convenience and necessity to withdraw their applications or show cause
why the applications should not be dismissed in light of passage of Public Act
141. The Commission today established a licensing procedure for all alternative
electric suppliers, and these suppliers will be able to operate throughout the state
without a certificate of public convenience if they obtains a license at the
Commission.
